The DJI Air 3S sold for the European market is C1 certified. That places it in Open subcategory A1, not A2, when the aircraft bears the required class marking and the operation meets the Open rules. Real-estate work can remain in Open even when it is paid; the category is determined by risk, people, airspace, and operating method rather than the invoice sent to the client.
Before a Spanish shoot, verify the actual aircraft label and Declaration of Conformity, the operator record, pilot training, location restrictions, and insurance position for that flight.
Use the Air 3S C1 and A1 route correctly
DJI confirms that the Air 3S is C1 certified in Europe. EASA places C1 aircraft in Open subcategory A1: no flight is expected over uninvolved people, any accidental overflight should be minimized, assemblies of people may not be overflown, and the operation remains below the applicable 120 m limit. The remote pilot needs A1/A3 online training and examination evidence.
The 30 m or 5 m low-speed distances belong to C2 operations in A2. They should not be presented as the normal Air 3S route. An A2 certificate can be useful for other C2 aircraft, but it does not convert a C1 Air 3S into a C2 operation.
Register the operator and verify the imported unit
AESA requires operator registration for an Open-category aircraft with a camera capable of capturing personal data, unless it is a qualifying toy. The operator number must be displayed on the aircraft and entered into remote identification where required. Registration belongs to the operator, not to the shop that sold the drone.
A China-market or pre-owned unit should not be assumed to carry the European C1 label merely because the model name is Air 3S. Photograph the class and CE markings on the actual aircraft, retain the matching EU Declaration of Conformity, and confirm that the serial and firmware identity match the unit. If the required product evidence is missing, ask AESA or the manufacturer how that exact unit may be operated before accepting a client job.

Check people, geo-zones, and the property plan
A C1 label does not create permission to fly anywhere. Review Spain's official UAS geographical-zone information for the address, check NOTAM or aeronautical restrictions where relevant, and plan launch, recovery, and emergency areas. A real-estate agent, owner, or photographer cannot waive airspace restrictions or the rights of uninvolved neighbours.
If the desired shot cannot avoid assemblies, cannot remain VLOS, or cannot comply with the relevant geo-zone and Open limitations, redesign the shot or use the Specific-category route. Obstacle sensing and forward LiDAR improve situational awareness but do not replace legal separation, pilot judgement, or an authorization.
Make the insurance decision under Spain's current rule
Spain no longer requires liability insurance for every sub-20 kg Open flight. Under Royal Decree 517/2024, Open A1 operations and sub-20 kg Open A3 operations are exempt from the cited statutory insurance obligation. A2 and Specific operations remain within the insurance requirement described by AESA. Client contracts, property owners, or professional risk controls may still require cover even when a statutory exemption applies.
Record the operation subcategory first, then confirm whether insurance is legally required and whether the client demands a policy. Do not use the commercial nature of the shoot as a shortcut for that analysis.
A clean pre-shoot evidence file
Keep the operator certificate, pilot training, aircraft class evidence, location check, weather decision, client permission, privacy plan, and pre-flight aircraft record together.
